Woman Sues Rental Car Company Alleging Employee Was Speeding, Drunk

A woman who claims a branch manager for Enterprise Rent-a-Car seriously injured her when he crashed into her parked car in Malibu on Mother’s Day while driving intoxicated and at high speed is suing the company.

Gwen Jordan’s Los Angeles Superior Court lawsuit alleges negligence and negligent entrustment, hiring, training, supervision and retention. The alleged driver of the car that hit Jordan, Joshua Adam Carlie, also is named as a defendant.

The suit filed Wednesday seeks unspecified damages. An Enterprise representative did not immediately reply to a request for comment.

Jordan was sitting in her parked car on Pacific Coast Highway about 8:20 p.m. May 12 when Carlie, driving a 2019 Ford Mustang nearly 100 mph and with a blood-alcohol level of 0.19, swerved onto the shoulder and hit the rear end of the plaintiff’s car, the suit states.

The complaint includes photos of Jordan in the hospital hooked up to a breathing tube as well as what remained of her car after it was hit.

Enterprise owned the car Carlie was driving and he was one of its branch managers, the suit states.

Jordan’s injuries included fractures to her back, ribs and pelvis, the suit states. She also suffered lacerations of her spleen, liver and right kidney, according to the complaint.

Carlie was negligent for driving while drunk and Enterprise was negligent for retaining him knowing he had prior criminal convictions for drug-related conduct and a poor driving history, the suit states.

It was unclear if Carlie was cited or charged stemming from the Malibu crash.

A posting by Jordan’s daughter, Dawn Jordan, on Pray.com states that her mother was sitting in her car on Mother’s Day watching the sunset when her car was hit. Jordan did not have her seat belt on because the car was parked and not running, the posting states.

Jordan’s car was pushed through a railing and over a ledge, the posting states.
