Man Who Fatally Stabbed Older Brother Sentenced

A 38-year-old man who fatally stabbed his older brother during an unprovoked attack at their family home near Hemet was sentenced Friday to 16 years to life in state prison.
An Indio jury in August found Timothy Anthony Condoluci of Hemet guilty of second-degree murder for the 2019 killing of 41-year-old Michael W. Condoluci, also of Hemet.
Along with the murder count, jurors convicted the defendant of a sentence-enhancing allegation of using a deadly weapon — a knife — in the commission of a felony.
Riverside County Superior Court Judge James Hawkins imposed the sentence required by law for the offenses.
According to the District Attorney’s Office, the defendant attacked his brother on the night of July 10, 2019, behind their family’s house at 26740 Green Ave., just south of Highway 74, in the community just east of Hemet known as Green Acres.
A trial brief filed by Deputy District Attorney Josh DeGonia said the two brothers had been at odds on numerous occasions, and family members consistently pointed to the defendant as the aggressor.
Three months before the deadly attack, Condoluci had threatened to stab his brother in the neck, prompting the victim and his mother to file a restraining order against him, DeGonia said.
On the night of the attack, for reasons unclear, Condoluci confronted the victim and told him that he intended to kill him as the two faced one another adjacent to the residence, according to court papers.
Without warning, the defendant pulled a hunting knife and plunged it into the victim’s right armpit, then turned and ran, prosecutors said.
Michael Condoluci managed to stumble to the front porch of the house, where he collapsed, prompting immediate calls to 911, according to the brief.
A deputy who had worked as an emergency medical technician was the first to reach the location and found the victim bleeding profusely and losing consciousness.
“The victim told (the deputy) that the defendant said, `He wanted to kill me,”’ according to the brief.
The deputy managed to stabilize the mortally wounded man, who was taken to Riverside University Medical Center in Moreno Valley, where he went into cardiac arrest and died four hours later on the operating table, according to court papers.
A K9 unit picked up Condoluci’s trail, and the defendant was located and taken into custody without incident near the house.
According to the brief, he made several spontaneous statements concerning the need to defend himself, even suggesting that his older brother had been armed with a handgun, which was never corroborated.
When a homicide detective spoke with the men’s uncle, the witness told him that a “long-standing feud” had resulted in repeated physical altercations between the brothers, with Michael Condoluci having to fend off his younger sibling, whom the uncle described as “exhausting” to deal with, the brief stated.
