Record Company Owner Sues Former Suicidal Tendencies Bassist

Former Suicidal Tendencies bassist Louis Mayorga is being sued by his ex-label owner, who alleges he failed to pay her $75,000 as part of a settlement of a lawsuit that he filed against her in 2016.
Lisa Fancher’s Los Angeles Superior Court lawsuit alleges breach of contract and fraud. Fancher is seeking at least $145,000 in the complaint, filed Monday.
Fancher owns Frontier Records, the label that funded the punk band’s first album and administers its master sound recording copyrights.
Mayorga’s lawyer, Eduardo Martorell, issued a statement Thursday regarding the Fancher suit.
“Ms. Fancher has not provided Mr. Mayorga with a royalty statement in over a decade as required by both their record deal and music industry standards,” the statement read. “She has not paid him any royalties in nearly a decade. She has never paid him a cent of streaming royalties, claiming their record deal requires all such royalties to be kept by the music label she personally owns and runs and does not require such royalties to be shared with the artists”
. In an attempt to deflect from the Mayorga suit, Fancher filed “this frivolous lawsuit” arising out of a failed settlement negotiation Mr. Mayorga conducted with his former attorney, which a judge determined was not enforceable, the statement further read.
In his lawsuit filed in December 2016, Mayorga alleged he was owed royalties from the 1983 punk song “Institutionalized.”
According to Fancher’s suit, she and Mayorga reached a settlement of his case in August 2017 in which he agreed to pay her $75,000. However, he did not tell her he could not afford to pay her, which amounts to fraud, according to Fancher’s suit.
The settlement was never finalized because Mayorga never paid the $75,000, so his case against Fancher is moving forward with trial set for March 2020. On Tuesday, Judge Stuart M. Rice granted a motion by Mayorga to conduct an audit of Fancher’s books and records.
